Terms and Condition - Giveaway October 2026
1. Organizer
The giveaway is organized by STARTFABRIK GmbH, Schloßstr. 2, 53773 Hennef, Germany, represented by Ruben Keferstein, trading under the brand BALOLO (hereinafter “Organizer”). Contact: info@balolo.de.
This giveaway is in no way sponsored, endorsed or administered by, or associated with, Instagram or Meta Platforms, Inc. The Organizer is the sole contact for all questions regarding the giveaway. By entering, participants release Instagram and Meta Platforms, Inc. from any and all liability in connection with the giveaway.
2. Prize
One (1) digital gift card worth USD 500 for the BALOLO online shop will be given away. The following applies to the gift card:
- It can be redeemed for orders to all countries that BALOLO ships to according to its Shipping Policy.
- It is issued in euros. The amount corresponds to USD 500, converted at the exchange rate on the day of issue. If payment in the shop is made in another currency, the euro amount is converted at the exchange rate on the day of redemption.
- It can be redeemed across several orders until the balance is used up.
- It has no expiry date. Statutory limitation periods apply.
- Cash redemption, exchange or transfer to other persons is excluded.
3. Entry period
The giveaway runs from the publication of the giveaway post on Instagram on 15 October 2026 until 22 October 2026, 11:59 pm (CEST). Entries received after this time will not be considered. A newsletter sign-up only counts if it has been confirmed (double opt-in) by the end of the entry period.
4. Eligibility
Participation is free of charge and does not require a purchase. By entering, participants agree to these terms and conditions.
- The giveaway is open to natural persons who are at least 18 years old at the time of entry and who reside in a country that BALOLO ships to.
- Persons residing in countries where the giveaway is prohibited by law or subject to special registration or approval requirements are excluded. Persons residing in countries subject to sanctions or embargoes are also excluded.
- Employees of STARTFABRIK GmbH, their relatives and employees of partners and agencies involved in the giveaway are also excluded.
- The Organizer may verify age and place of residence before handing over the prize.
5. How to enter
To enter, participants must:
- follow the @balolo account on Instagram,
- like the giveaway post, and
- leave a comment under the post tagging two other Instagram accounts.
Each Instagram account receives one (1) entry. Multiple comments do not increase the chances of winning. The requirements must still be met at the time of the draw.
Bonus entry via the newsletter (optional): Anyone who signs up to the newsletter list for the giveaway via this form during the entry period and confirms the sign-up (double opt-in) receives one (1) additional entry. This also applies to existing subscribers who sign up via the form. The bonus entry is only valid if a valid entry according to steps 1 to 3 also exists; otherwise a new winner will be drawn. Signing up is not a requirement for entering the giveaway. Consent to the newsletter can be withdrawn at any time; this does not affect the bonus entry. Each person can receive a maximum of two (2) entries.
6. Winner selection and notification
Within seven (7) days after the end of the giveaway, i.e. by 29 October 2026, the Organizer will draw one (1) winner at random from all valid entries.
The winner will be notified by direct message from the official @balolo account or by email to the address provided for the newsletter. Emails are sent exclusively from addresses of the official domain @balolo.de. The Organizer will never ask for passwords, payment details or fees. Messages from other accounts or domains are not prize notifications.
The winner must respond within seven (7) days of notification, providing their name, email address, country of residence and, upon request, proof of age. Otherwise the prize is forfeited and the Organizer may draw a new winner.
7. Prize fulfillment
The gift card will be sent digitally to the email address provided within 14 days of the winner’s response. Any additional costs for orders paid with the gift card, such as customs duties, import fees or taxes in the destination country, shall be borne by the winner.
8. Disqualification
The Organizer may exclude participants and withdraw a prize, even after the draw, if they:
- provide false information,
- use fake or multiple accounts,
- enter by automated means or otherwise manipulate the giveaway,
- violate Instagram’s Terms of Use, or
- post offensive, discriminatory or unlawful comments.
9. Liability
The Organizer is liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act (Produkthaftungsgesetz).
In cases of slight negligence, the Organizer is only liable for the breach of an essential obligation whose fulfillment is necessary for the proper conduct of the giveaway. In this case, liability is limited to the foreseeable damage typical for this type of giveaway. Otherwise, liability for slight negligence is excluded, in particular for technical faults on Instagram or in the transmission of entries.
10. Data protection
The controller responsible for data processing is STARTFABRIK GmbH (see Section 1 for contact details).
Data processed: Instagram username, comment including tagged accounts, and information on whether the entry requirements are met. For the bonus entry, additionally the email address. For the winner, additionally name, email address, country of residence and, if required, proof of age.
Purpose and legal basis: The data is processed to run the giveaway, carry out the draw, notify the winner and hand over the prize (Art. 6(1)(b) GDPR). Processing for the newsletter is based on consent (Art. 6(1)(a) GDPR) and is governed by BALOLO’s privacy policy. The winner’s Instagram username will only be published on BALOLO’s social media profiles with their consent (Art. 6(1)(a) GDPR, see Section 11).
Recipients: For the newsletter and the bonus entry, we use Klaviyo (Klaviyo, Inc., Boston, USA). The data is processed in the USA. The transfer is based on Klaviyo’s certification under the EU-U.S. Data Privacy Framework and the EU Standard Contractual Clauses. Meta’s Privacy Policy also applies to processing on Instagram.
Retention period: Entry data will be deleted no later than 3 months after the prize has been handed over, unless statutory retention obligations apply.
Participants’ rights: Participants have the right to access, rectification, erasure, restriction of processing, data portability and objection, as well as the right to lodge a complaint with a data protection supervisory authority. Consent given can be withdrawn at any time with effect for the future. If entry data is deleted before the draw, participation is no longer possible. Further information: BALOLO Privacy Policy.
11. Publication of the winner
With the winner's consent, their Instagram username may be published on BALOLO’s social media profiles.
12. Changes and early termination
The Organizer may change, suspend or end the giveaway in whole or in part for good cause. Good cause exists in particular in the event of technical faults, attempts at manipulation or legal reasons that prevent the giveaway from being conducted properly. If the prize is no longer available for reasons beyond the Organizer’s control, the Organizer may provide a replacement prize of equal or higher value.
13. Final provisions
These terms and conditions are governed by the laws of the Federal Republic of Germany. Mandatory consumer protection provisions of the country in which participants have their habitual residence remain unaffected.
Should any provision of these terms and conditions be invalid, the validity of the remaining provisions shall not be affected. In the event of any discrepancy between the language versions, the German version shall prevail.
